On February 25th 2015 at Liverpool County Court 3 airlines – Jet2, Ryanair & Wizz Air – requested to put all flight compensation claims on hold – both litigated and pre litigated – until a decision was made in the European Court of Justice on the Van Der Lans and KLM case.
Yesterday on February 26th 2015, Liverpool District Judge Jenkinson handed down his judgment, and rejected the Airlines’ (Flybe were also refusing to pay as they awaited this decision) applications to stay all flight delay compensation claims until the decision of the ECJ in the Van Der Lans Case and KLM case.
This means that flight compensation claims should now start to be heard in the Liverpool County Courts and we are hoping other Courts will now follow suit and start hearing flight delay compensation cases.
This is great news for you the passenger and although it is highly probable that the airlines involved will decide to appeal the judgment, this is still a major step in the right direction as we continue to fight for the rights of the passengers. We will continue to vigorously pursue all the airlines to pay your compensation. More of the airlines are now working with us to settle all our existing claims and we will continue to work tirelessly to win the flight delay compensation that you the passenger are entitled to.
